Terms of Service
1) Definitions
- "DeskBuddy," "we," "us," "our": DeskBuddy and its affiliates.
- "Customer," "you," "your": the business account holder using the Service.
- "Caller(s)": people who call the Customer and interact with the Service.
- "Customer Data": data processed through the Service, including call metadata, (if enabled) recordings, transcripts/summaries, appointment details, and configuration.
2) Acceptance of Terms
By creating an account, checking a consent box, or otherwise accessing or using the Service, you agree to these Terms and our Privacy Policy, incorporated by reference.
3) Eligibility; Account Security
You must be at least 18 years old to use the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
4) Service Description; Changes
DeskBuddy provides an AI-powered inbound call answering and appointment scheduling assistant for local businesses, including FAQs, booking workflows, and optional call transfer and integrations.
We may modify or discontinue parts of the Service from time to time.
5) Compliance Responsibilities (Inbound Calling; Recording)
DeskBuddy is a configurable tool. You are responsible for how you deploy it and for compliance with applicable laws.
5.1 Call recording and consent
If you enable recording and/or transcription:
- you are responsible for providing any required "call may be recorded" notice;
- you are responsible for obtaining any required consent(s).
Call recording consent laws differ by jurisdiction and may depend on where you and your Callers are located.
5.2 General legal compliance
You agree to comply with all applicable laws related to your use of the Service, including privacy, consumer protection, and telecommunications rules.
Note: DeskBuddy currently supports inbound calls only. If outbound calling is introduced later, additional terms may apply.
6) AI Limitations; Accuracy
The Service may produce transcripts, summaries, suggested answers, and booking actions.
You acknowledge:
- AI outputs may be inaccurate or incomplete;
- you are responsible for verifying critical business decisions (e.g., appointment details, pricing, availability, safety instructions);
- DeskBuddy does not provide legal, medical, or other professional advice.
7) Integrations (including Google Calendar)
The Service may integrate with third-party services (e.g., Google Calendar, Mindbody, Square, telephony providers, and speech services).
7.1 Your authorization
If you connect a third-party account, you authorize DeskBuddy to access and process data from that account as permitted by the permissions ("scopes") you grant.
For example, if you connect Google Calendar, you may grant DeskBuddy permission to read, create, update, and delete calendar events, depending on the scopes you approve.
7.2 Purpose limitation
When you grant calendar permissions, DeskBuddy will use that access only to provide the Service's user-facing scheduling features (e.g., checking availability, creating or updating booking events, and preventing double bookings), as described in our Privacy Policy.
7.3 Revocation
You may revoke an integration's access at any time through the third-party provider (e.g., your Google account settings) or via the DeskBuddy dashboard (where available). Revocation may limit or disable scheduling features.
7.4 Third-party terms apply
Third-party services are governed by their own terms and policies. DeskBuddy is not responsible for third-party outages, errors, or data handling beyond our reasonable control.
8) Customer Data; License to Process
As between you and DeskBuddy, you own Customer Data.
You grant DeskBuddy a limited license to process, host, store, and transmit Customer Data to provide, maintain, secure, and improve the Service, consistent with our Privacy Policy.
9) Acceptable Use
You may not use the Service to:
- violate law or third-party rights;
- harass, threaten, impersonate, or engage in unlawful surveillance;
- transmit malware, scrape, or interfere with the Service;
- attempt to reverse engineer the Service except as allowed by law.
We may suspend or terminate access for violations.
10) Fees; No Refunds
The Service is generally offered on a subscription basis.
All fees are non-refundable, except where required by law or expressly stated in writing by DeskBuddy.
11) Suspension; Termination
You may stop using the Service at any time and cancel through the methods described in the Service.
We may suspend or terminate your access if we reasonably believe:
- you violated these Terms;
- your use creates legal/compliance risk; or
- we are required to do so by law.
12) Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESKBUDDY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
13) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- DESKBUDDY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
- DESKBUDDY'S TOTAL LIABILITY FOR ALL CLAIMS IN ANY 12-MONTH PERIOD WILL NOT EXCEED THE AMOUNT PAID BY YOU TO DESKBUDDY FOR THE SERVICE DURING THAT PERIOD.
14) Indemnification
You will indemnify and hold DeskBuddy harmless from third-party claims arising out of:
- your configuration or use of the Service;
- your failure to provide required notices or obtain required consents;
- your Customer Data or your instructions to the Service;
- your violation of law.
15) Changes to These Terms
We may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., via dashboard notice or email). Continued use after the effective date means you accept the updated Terms.
